REFER A FRIEND PROMOTION 2008/09

Conditions of Entry

  1. Information on how to enter and the winner prize form part of these conditions of entry. Entry into the promotion is deemed acceptance of these conditions of entry. Entry is via web address at www.spiritoftasmania.com.au/refer.

  2. Entry is open to all Spirit of Tasmania passengers who travel between 1 July 2008 and 31 May 2009 and who live in Australia. Employees and their immediate families of the promoter and printers, suppliers, providers and agencies associated with this promotion are ineligible.

  3. The promotion commences on 10 October 2008 at 9.00am (EST) and concludes on 31 July 2009 at 11.59pm (EST).

  4. To enter the promotion, eligible participants who receive a letter in the mail advising them of the promotion, will be invited to refer a friend by logging onto www.spiritoftasmania.com.au/refer. These participants will need to complete an online referral form by the closing date of the special offer. The referred friend will receive an email with details of an exclusive special offer. The referred friend must then book the special offer with Spirit of Tasmania using the fare code supplied, by the closing date as specified in the email. The referred friend must be referred with a valid email address and make a booking with the same email address used to refer them. Upon completion, both the referrer and the referred friend will be entered into the draw.

  5. Entries without a valid email address will be ineligible for entry into the draw.

  6. Each individual referral will entitle the entrant to one entry in the major prize draw.

  7. The Promoter, in its absolute discretion, reserves the right to verify the validity of all entries before awarding a prize and to disqualify any entrant who tampers with the entry process or who submits an entry that is not in accordance with these conditions of entry.

  8. Entries will be deemed to be accepted at the time of receipt and not at the time of transmission. Incomplete, inaudible or incomprehensible entries will be deemed invalid. No responsibility will be taken for lost, late or misdirected entries.

  9. The major prize draw will take place on 10 August 2009 at 11am (EST) at Be.interactive, Level 9, 155 George St, Sydney NSW 2000. The winner will be notified by phone and mail and the winner’s details will be published in the public notices section of The Australian newspaper on 19 August 2009.

  10. Major prize: The first valid entry drawn will receive $5,000 towards their next holiday. The winner can redeem their prize by booking at a licensed travel agent chosen by Spirit of Tasmania who will then invoice TT-Line Company Pty Ltd trading as Spirit of Tasmania. The prize must be booked by 31 March 2010. The prize cannot be used in portions. The prize is not transferable, exchangeable or redeemable for cash.

  11. The total maximum prize pool is valued at up to $5,000 (including GST). 

  12. If the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value, subject to state regulation.

  13. The prize must be taken as offered and cannot be varied. Prize values are GST inclusive and are in Australian dollars and are the recommended retail value as provided by the supplier and are correct at time of printing. The Promoter accepts no responsibility for any variation in prize value.

  14. In the event that for any reason whatsoever the winner does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize.

  15. Should the prizes remain unclaimed; an unclaimed prize draw will take place on 2 December 2009 at 11am (EST) at Be.interactive, Level 9, 155 George St, Sydney NSW 2000. The winner will be notified by mail and their name published in the public notices section of The Australian newspaper on 9 December 2009. 

  16. Entrants consent to the Promoter using their name, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period of time without remuneration for the purpose of promoting this promotion (including any outcome) and promoting any products manufactured, distributed and/or supplied by the Promoter.

  17. All other expenses, including spending money, meals (unless otherwise stated), travel to and from departure point, transfers (unless otherwise stated), visas, additional travel insurance and all other ancillary costs are the responsibility of the winner. The winner of the major prize is responsible for arranging all other travel requirements including visas. Incidental charges charged to the winner’s room, such as meals, services, telephone calls etc, are at the expense of the winner. Unless expressly stated all other expenses become the responsibility of the winner.

  18. Programming and other quality control errors will not invalidate an otherwise valid prize claim. Unless otherwise due to fraud or ineligibility under these conditions of entry, all valid prize claims in excess of the advertised prize pool will be honoured.

  19. The Promoter’s decision in relation to any aspects of the promotion is final and binding on every person who enters and no correspondence will be entered into.

  20. The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability which cannot be excluded by law. The Promoter is not responsible for any incorrect or inaccurate information either caused by programming associated with or utilised in this promotion, or for any technical error, or any combination thereof that may occur in the course of the administration of this promotion including any omission, interruption, deletion, defect, delay in operation or transmission, communications line, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.

  21. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.

  22. All entries become the property of the Promoter. The Promoter collects personal information about entrants to enable participation in this promotion but no further use of this information will be made. To facilitate participation, the Promoter may disclose personal information to other companies associated with this promotion. If entrants do not provide personal information, the Promoter will not be able to enter them into this promotion.

  23. If for any reason this promotion is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter, which corrupt or affect the administration security, fairness or integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, and, subject to any written directions given by the various lottery departments, to cancel, terminate, modify or suspend the promotion.

  24. In the case of the intervention of any outside agent or event which naturally changes the result or prevents or hinders it's determination including (but not limited to) vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strikes; the Promoter may in its absolute discretion cancel the event and recommence it from the start on the same conditions subject to State Regulation.
