Terms and Conditions

  1. Information on how to enter and prize details form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

  2. The ‘Promoter’ is TT-Line Company Pty Ltd (trading as Spirit of Tasmania).

  3. Entry to this competition is restricted to residents of Victoria, New South Wales and Tasmania, aged 45 and above.

  4. All employees of the Promoter, its related corporate bodies and the immediate families of such employees are ineligible to enter.

  5. The competition commences 12:01am (AEST) 15 September 2008 and closes 11:59pm (AEDST) 30 November 2008. Entry to this competition is via website spiritoftasmania.com.au/ihavethespirit.htm or via mail to Have you got the Spirit? Promotion, PO Box 323, Port Melbourne, Victoria 3207.

  6. Entrants are required to write in 250 words or less the reasons why they believe themselves or their nominee to be worthy of the title, “Spirit of Tasmania’s Most Active Adult”.

  7. Incomplete, indecipherable or illegible entries will be deemed invalid.

  8. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

  9. The Promoter reserves the right to reproduce entries received on the Spirit of Tasmania website and or through media outlets.

  10. The total prize pool is valued at AUS$15,870 and consists of two (2) prizes. The two prizes will be awarded to two winners with one winner chosen from entries received by Victorian and New South Wales residents and one winner chosen from entries received from Tasmanian residents.

  11. Spirit of Tasmania’s standard Terms and Conditions of Travel apply to all prizes. These can be found at spiritoftasmania.com.au/terms.htm. Pure Tasmania's terms and conditions apply to the accommodation prize. These can be found at puretasmania.com.au.

  12. The prize for the one winner from either New South Wales or Victoria includes a return trip for four adults in two Spirit of Tasmania Deluxe Cabins and one standard car, departing from Melbourne, Victoria. This prize also includes a Pure Tasmania Experience for four people including two nights accommodation at the Cradle Mountain Chateau in a Split Level King Spa room with a full breakfast included each morning and four tickets on the Reflections and Rainforest Canoe. Then to follow, three nights accommodation at Strahan Village in a Hilltop Executive Harbour View room including a full breakfast each morning and a Wine and Cheese Tasting at Strahan’s View 42 Restaurant & Bar. This prize also includes four tickets on a steam train in Premier Class on the West Coast Wilderness Railway. All components of this prize are subject to availability and the accommodation is based on four people sharing two rooms. Total prize value is AUS$7,812. No flights are included in this prize. This prize is valid from 19 January 2009 until 13 December 2009 and cannot be taken in school or public holidays.

  13. The prize for the one winner from Tasmania includes a return trip for four adults in two Spirit of Tasmania Deluxe Cabins and one standard car, departing from Devonport. Our winners on arrival in Melbourne will then enjoy two nights accommodation for four in a Two Bedroom Apartment at Mantra on Russell, Melbourne. This includes complimentary wine & chocolates on arrival, a full breakfast for four daily in Up One Restaurant and late check out of 12.00pm. While in Melbourne our winner and guests will experience the Eureka Skydeck including the thrill of ‘The Edge’ and also relax on a Melbourne River Cruise. The travellers will then go on to enjoy three nights accommodation for four people in a Premiere Suite with an interconnecting Studio View Room, daily breakfast and 18-holes of golf with cart for four people at Peppers the Sands, Torquay. While in Torquay they will luxuriate in a Deep Relaxation treatment at Saltair Spa Retreat. All components of this prize are subject to availability. This prize is valued at AUS$8,058. No flights are included in this prize. This prize is valid from 19 January 2009 until 13 December 2009 and cannot be taken in school or public holidays.

  14. The entries will be judged by a panel consisting of Max Walker, Charles Griplas (CEO, Spirit of Tasmania) and Sue Preston (Editor, Australian Senior Traveller). The judging will take place at Spirit of Tasmania, Station Pier, Port Melbourne, Victoria 3207 on Monday 8 December 2008 at 10.00am (AEST).

  15. The judges will be instructed to select the two winners, one from either Victoria or New South Wales and one from Tasmania.

  16. Judges will be instructed to select the ‘active adult’ who has, in their opinion, demonstrated the most spirit. Criteria to guide them will include the level of their achievements, the impact of those achievements on others, whether these achievements can be considered unusual and unique for a person of that age or any other person, perhaps they have overcome great adversity, perhaps their story contains an element of fun, perhaps their story contains an element of sadness.

  17. If a prize (or part of a prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

  18. The winners will be notified by telephone and mail and published in the Public Notices section of The Australian newspaper on Thursday 11 December 2008. Winners will also be published on spiritoftasmania.com.au.

  19. The prizes are non-transferable and cannot be exchanged or taken as cash.

  20. The Promoter’s decision is final and binding, and no correspondence will be entered into.

  21. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

  22. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, whether to an entrant, winners or any guests of winners, or any other person, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any tax liability incurred by a winner or entrant; or (e) use of a prize.

  24. The Promoter collects personal information in order to conduct the Promotion. The name and address details of entrants may be used as a mailing list for future promotions and marketing carried out by the Promoter, including via electronic messages and telephoning the entrant. Entrants can request to access, update or correct information or request not to receive information about future promotions by calling 1800 634 906 or emailing privacy@spiritoftasmania.com.au
